Welcome to 1 Day Cleanouts LLC, DBA Temecula Valley Junk Pick-Up ("Company," "we," "us," or "our"). By accessing our website, using our junk removal, cleanout or related services ("Services"), or communicating with us electronically (including by SMS), you agree to the following Terms and Conditions. Please read them carefully.

1. Service Overview

Temecula Valley Junk Pick-Up provides full-service junk removal, cleanouts, and related hauling or labor services for residential and commercial properties. Services include, but are not limited to, item removal, demolition of small structures, disposal, donation pickups, and donation or recycling of eligible items.

2. Estimates and Pricing

  • All pricing is based on volume, labor, type of material, access, and disposal fees.
  • Pricing is confirmed on site before work begins. Quotes are non-binding until approved by the client.
  • Any additional items or changes during service must be approved by the client and may require a change order.
  • We reserve the right to update pricing if the scope of work changes.

3. Payments and Billing

  • Payment is due upon completion of service unless otherwise agreed to in writing.
  • We accept cash, check, credit/debit cards, ACH, Zelle, and escrow billing (for qualifying real estate transactions, upon approval).
  • Escrow billing: if the property falls out of escrow, payment is due within 7 calendar days. If the property is removed from the market, the listing agent is responsible for payment.
  • A 10% monthly late fee may apply to overdue accounts. Invoices not paid within terms may be subject to collections and legal fees.

4. Cancellations and Rescheduling

  • We ask for at least 24 hours' notice for cancellations or rescheduling.
  • A $50 cancellation fee may apply to cancellations made less than 24 hours before the appointment, and to no-shows.
  • We reserve the right to reschedule due to weather, traffic, vehicle or equipment issues, or other events outside our control, and we are not liable for resulting delays.

5. Item Removal Policy

  • You affirm that you have the authority and legal right to dispose of all items we are removing.
  • Once removed, items cannot be retrieved.
  • We reserve the right to decline removal of hazardous, biohazardous, or prohibited materials (for example chemicals, oils, or asbestos).
  • E-waste or special disposal fees may apply and will be quoted in advance.

6. Property Access and Liability

  • By hiring us, you grant us and our employees permission to access your property to perform the agreed-upon services.
  • While we take great care to protect your property (for example with floor runners and protective gear), we are not liable for:
  • Pre-existing damage or normal wear and tear
  • Unstable or unsafe structures
  • Damage resulting from removal of items embedded in walls, floors, or ceilings
  • Items removed that were not clearly marked or communicated as items to keep
  • It is the client's responsibility to secure pets, valuables, personal items, and confidential materials or data before service.

7. Indemnification

You agree to indemnify, defend, and hold harmless 1 Day Cleanouts LLC and its employees, agents, and affiliates from any claims, damages, losses, or expenses arising from misrepresentation of item ownership, failure to disclose hazardous or restricted items, your use or misuse of our Services, or any breach of these terms.

8. No Warranties

Our Services are provided "as is" without warranties of any kind, either express or implied, except as required by law.

9. Limitation of Liability

To the fullest extent permitted by law, 1 Day Cleanouts LLC is not liable for any indirect, incidental, or consequential damages, including lost profits, arising from your use of our Services or website.

10. Mobile Messaging Terms (A2P 10DLC Compliance)

Temecula Valley Junk Pick-Up sends text messages about scheduling, appointment reminders, service updates, and occasional promotional offers. By providing your phone number and opting in, you agree to receive these messages.

  • Message frequency varies. Message and data rates may apply depending on your mobile plan.
  • You may opt out at any time by replying STOP to any message.
  • For help, reply HELP or contact us at hello@temeculajunk.com.
  • We do not share, sell, or use your mobile information for third-party marketing or promotional purposes. Your opt-in data and consent are never shared outside of our business operations.

11. Intellectual Property

All content on our website, marketing materials, and digital media is the property of 1 Day Cleanouts LLC unless otherwise credited. Reproduction or use without written permission is prohibited.

12. Changes to Terms

We may update these Terms and Conditions at any time. Updates will be posted on our website with a revised "Last updated" date. Continued use of our Services constitutes your agreement to the updated terms.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.
